About Aparna Nanayakkara

Aparna specialises in complex financial services litigation, regulatory investigations and enforcement proceedings, class actions and commercial disputes. Her experience also includes large-scale insolvency and restructuring matters. She has acted for clients across a range of industries, including banking and financial services, utilities, infrastructure, government, telecommunications and education.

Aparna's litigation practice includes disputes in relation to market manipulation, misleading and deceptive conduct, unconscionable conduct, breach of contract, breach of directors' duties, auditor negligence, shareholder class actions and financial crime.

Aparna's recent experience includes:

  • acting for Westpac in relation to the penalty proceedings commenced by AUSTRAC alleging breaches of the AML/CTF Act;
  • acting for Westpac in relation to the penalty proceedings commenced by ASIC alleging market manipulation of the Bank Bill Swap Rate (BBSW) and unconscionable conduct;
  • acting for Vocation Limited in relation to three separate class action proceedings brought by the company's shareholders in relation to various claims, including misleading and deceptive conduct;
  • defending the penalty proceedings brought by ASIC against the former Chief Executive Officer of Vocation Limited alleging contraventions of the continuous disclosure regime, misleading and deceptive conduct and breach of directors' duties;
  • acting for KPMG in relation to an auditor negligence claim brought by the liquidators of Equititrust Limited;
  • acting for News Limited in relation to proceedings brought by the Special Purpose Liquidator of One.Tel in relation to claims of breaches of directors' duties;
  • advising Ausgrid in relation to disputes with a NSW electricity generator, including in relation to the contractual arrangements between the parties;
  • advising PPB Advisory as receivers and managers of the $3.5bn Airport Link M7 toll road;
  • acting for large listed entities in relation to their dealings with regulators, including ASIC and the ASX. Relevant experience includes advising in relation to internal investigations as well as disclosure issues; and

acting for various financial institutions in relation to debt recovery and other insolvency issues, including advising receivers and commencing winding up proceedings.
