About James Somerville

James specialises in competition and consumer law.

James advises clients on all aspects of competition and consumer law, including in relation to engagement with the ACCC in the context of mergers, authorisations, investigations and litigation.

James brings clients his experience gained from spending almost 10 years in the in-house legal group at the Australian Competition and Consumer Commission, where he advised the ACCC in a range of enforcement, merger and authorisation matters.

James’s relevant experience includes:

  • Sony Interactive Entertainment – acting for Sony in ACCC proceedings for alleged misleading conduct relating to PlayStation games purchased through Sony's online store.
  • Coles – securing ACCC authorisation for Coles and to cooperate with other supermarkets during the COVID-19 pandemic.
  • Vocus – acting for Vocus’ retail subsidiaries Dodo and iPrimus in ACCC proceedings for alleged misleading conduct relating to their NBN broadband products.
  • Major retailer – obtaining ACCC merger clearance and providing competition advice in relation to a sale of assets and outsourcing arrangement.
  • Coles – acting for Coles in relation to ACCC investigation into claims regarding rebates to be paid to dairy farmers. The matter was resolved administratively.
  • Large financial institutions – advising a range of financial institutions in relation to competition aspects of ECM, syndicated lending and other arrangements with other lenders.
  • Medical devices manufacturer – in relation to an application for informal clearance from the ACCC of a proposed acquisition.
  • Pharmaceuticals – providing competition law advice to major pharmaceutical providers in relation to competition aspects of their supply arrangements.
