About Malcolm Stephens

Malcolm is a commercial litigator with extensive experience acting for clients in some of Australia's largest and most complex commercial disputes. He has litigated in a range of jurisdictions from state Supreme Courts to the High Court. He has also handled a number of domestic and international arbitrations, expert determinations and mediations.

Malcolm has a broad commercial litigation practice, with particular expertise in the areas of tax litigation, M&A disputes, banking law, regulatory investigations, corporations law, administrative law and complex insurance matters. His clients include leading companies in the retail banking, investment banking, media, defence and insurance sectors.

Malcolm's understanding of the law and his commerciality enable him to identify quickly the critical legal and factual issues. He provides plain-English advice and his recommendations are clear and concise.

In addition to his litigation practice, Malcolm works closely with his commercial and corporate partners to provide practical advice to clients on issues that arise during contract negotiations and at the early stages of any potential dispute.

Malcolm edits the firm's annual 'Contract Law Update' and is a regular presenter of seminars on areas including contractual interpretation; tax disputes; insurance law; indemnity clauses; constitutional law and privilege. Malcolm has frequently been listed as a leading insurance lawyer by Chambers Global and has been trained formally in Legal Project Management.
