Linklaters Insights: China's highest judicial body identifies positive steps in the enforcement and protection of intellectual property rights in China

2012 saw some small, but positive, steps in the area of intellectual property enforcement within China, according to the recently released 2012 annual report of China's Supreme People's Court.

In its report, the SPC has also provided some guidance on protecting intellectual property rights in China. Of particular relevance to foreign investors in China, the SPC has provided some useful guidance on protecting trade marks and commercially sensitive information when conducting business in China, as well as the rights afforded to trade mark holders in China.
