About Isobel Rosenstreich
Isobel specialises in commercial disputes, and has particular expertise in contractual disputes, corporate governance and corporate insolvency. She has been involved in a number of major commercial litigation matters, and has experience resolving disputes through litigation, mediation and expert determination. Her practice encompasses assisting financial institutions and insolvency practitioners in a variety of matters involving the enforcement of securities and debt recovery, including in the energy and resources sector.
Isobel's recent key matters include acting for/advising:
- Bluewaters Power Station on several proceedings in both the Federal Court and Supreme Court of Western Australia, including: expedited injunction proceedings in relation to intercreditor arrangements and, separately, a key supplier; examination proceedings in the Federal Court; and several applications seeking court directions as to specific issues
- KPMG as voluntary administrators to a mining business, including its sale and restructure through a deed of company arrangement, requiring various court applications and engagement with non-conventional secured lenders
- a major energy participant on a financial and supplier restructuring following a critical supplier's insolvency, including insolvency options, banking arrangements, safe harbour planning, and engagement with government and regulators, with broader energy security and transition implications
- McGrathNicol as receivers of Quintis Ltd in contentious matters subject to court proceedings to recover the company's books and records, as well as public examinations
- Quintis in disputes with its former CEO and associated parties arising from meetings of managed investment scheme members, and to recover money owing under loan agreements in the Supreme Court of Western Australia and the Federal Court
- a major Australian bank as the lender in two Supreme Court of Western Australia proceedings to recover principal loan amounts of $19.5 million
- various financial institutions in the defence of claims by current and former customers.
