About 陈祥源 Tommy Chen

Tommy is a Managing Associate in Allens' Intellectual Property team in Sydney. With deep insight and broad experience gained from more than 10 years of global experience in intellectual property and technology law, Tommy helps clients put in place arrangements to protect and realise the value of their IP, and to resolve their most complex IP issues.

Tommy has particular expertise in the IP aspects of mergers and acquisitions, public and private capital raisings, joint ventures and strategic investments. He also has significant experience advising on IP licensing arrangements and research and development collaborations, as well as corporate IP governance. Tommy has acted for clients in disputes relating to patents, trade marks, copyright, confidential information, and software licensing. Tommy has specialist knowledge in the IP aspects of international trade law and free trade agreements, and has advised clients in relation to the Nagoya Protocol and access benefit sharing.

Some of Tommy’s recent experience includes:

  • Commonwealth Bank of Australia – on its US$300 million investment into buy-now-pay-later provider, Klarna, and associated strategic partnership in Australia.
  • AstraZeneca Pty Ltd – on the manufacturing arrangements between AstraZeneca and CSL Limited for the manufacture of the AstraZeneca/Oxford University COVID-19 vaccine (AZD1222) in Australia.
  • Healthe Care Australia Pty Ltd – in relation to restructuring and sale of surgical business and potential IPO of specialty healthcare business.
  • KKR – on the A$3.14 billion acquisition of Arnott's Biscuits and other international business of Campbell Soup Company.
  • TransGrid – on the IP aspects of the 50MW/75MWh Wallgrove battery project to be delivered by Tesla.
  • Ford Motor Company – in a trade mark dispute with a former dealer.
  • SIX Group – on the US$2.75 billion sale of its payment system division to Worldline (French payment service provider) and SIX’s acquisition of part of Worldline.
  • Sierra Wireless – in arbitration against Nokia in relation to licensing of standards essential patents.

Tommy is also qualified as a solicitor-advocate in England and Wales. Tommy is a member of the standing committee on trade marks of the International Association for the Protection of Intellectual Property (AIPPI) and the NSW committee of the Intellectual Property Society of Australia and New Zealand (IPSANZ).
