About Tracy Lu

Tracy is an IP all-rounder with over 10 years of strong experience in both commercial and contentious IP matters. She has extensive expertise in advising on complex IP arrangements, high-stakes patent disputes and the IP aspects of market-leading M&A transactions, including in the London market where she was a secondee at Linklaters. She acts for a broad range of clients ranging from startups, research institutions and retail businesses, to global innovation leaders, banks and super funds, and private equity houses, and her practice has a particular focus on the technology, financial services and healthcare sectors.

Tracy's notable contentious matter experience includes advising:

  • Seiko Epson, in enforcement actions on e-commerce platforms, and patent proceedings that culminated in the High Court's seminal judgment on the application of the doctrine of patent exhaustion in Australia.
  • Cytec Industries, in Federal Court patent opposition proceedings in relation to an industrial chemical process.
  • Beiersdorf Australia, in Federal Court proceedings defending against allegations of misleading or deceptive advertising claims relating to deodorant products.
  • Music Rights Australia, in Federal Court proceedings acting on behalf of Australian record companies to obtain an injunction against ISPs to block access to a torrent website.
  • Teva, in patent disputes involving Copaxone® (glatiramer acetate) and rasagiline.
  • Otsuka / BMS, in Federal Court patent proceedings involving Abilify® (aripiprazole).

Tracy's notable commercial experience includes advising:

  • Paine Schwartz Partners, on the IP aspects of the $A2.459b take private of ASX-listed Costa Group Holdings.
  • Malteries Soufflet, on the IP aspects of the A$1.5b acquisition of United Malt Group.
  • Hillhouse Capital, on the IP aspects of the €3.7b acquisition of the Philips global domestic appliances business.
  • Sony Music Publishing, on its global deal with Tame Impala.
  • ASC, in relation to its collaboration with BAE in respect of the SSN-AUKUS submarines.
  • Westpac, on trade mark enforcement and advertising clearance matters.
  • News Corp, on copyright infringement matters and various acquisitions and sales of media and publishing businesses.

Tracy has been recognised as a Finalist in the IP category in the Lawyers Weekly '30 Under 30' Awards. She is also a member of the NSW Local Committee of the Intellectual Property Society of Australia and New Zealand (IPSANZ).
