About David Mierendorff
David is a Managing Associate in our Competition, Consumer & Regulatory team.
He advises clients on competition and consumer law compliance, investigations and litigation, navigating complex commercial negotiations and ACCC merger clearances. He has particular experience in access to infrastructure and economic regulation matters, including on the declaration of infrastructure facilities, price and revenue regulation, economic regulatory resets and ring-fencing obligations.
David works with clients in a broad range of industries, including energy, aviation and financial services—with a special interest in telecommunications, having worked inhouse in the competition and regulatory legal team at nbn from mid-2021 to mid-2025. He has been recognised as a noted practitioner in the Legal 500 index for competition and trade practices law in Australia.
David's recent experience includes advising:
- nbn: on various issues, including pricing and revenue regulation under nbn's Special Access Undertaking (SAU)
- ANZ: on the defence of criminal cartel proceedings brought against ANZ, two global investment banks and six senior executives in relation to an ANZ institutional share placement
- Airports: on regulatory access and competition law issues, including the Productivity Commission inquiry into the economic regulation of airports
- Electricity transmission networks, generators and retailers: on various competition law and regulatory issues, including energy market misconduct regulation, revenue determinations and the regulatory investment test
- Bayer: on the sale of its animal health business to Elanco
- A consortium led by CK Infrastructure (CKI): on a proposed acquisition of listed Australian energy infrastructure business, APA.
