About Erin Molony
Erin is a competition and consumer law specialist, advising clients on compliance, regulatory investigations and disputes (as well as private actions), and merger clearances. She works with clients in a broad range of industries including energy, tech, financial services and retail.
Erin has experience helping clients to navigate investigations and court proceedings initiated by the ACCC, Australian Energy Regulator and Essential Services Commission—from initial regulator engagement through to negotiated resolutions and litigation.
Erin's competition enforcement and litigation experience includes advising:
- Epic Games in two Federal Court proceedings against Apple and Google, alleging misuse of market power and other anti-competitive conduct in mobile app distribution and in-app payment systems; this was Australia's first big tech antitrust litigation, involving complex expert evidence across technology, security, payments, antitrust economics, econometrics, behavioural economics and forensic accounting
- Australia and New Zealand Banking Group on the landmark criminal cartel proceedings brought by the ACCC and the Commonwealth Director of Public Prosecutions
- Origin Energy in proceedings brought by the Australian Energy Regulator alleging breaches of hardship obligations under the National Energy Retail Law and Retail Rules; and in two proceedings brought by the Essential Services Commission alleging breaches of the payment difficulties, life support and billing protections under the Electricity Retail Code of Practice
- Alinta on an Australian Energy Regulator investigation and enforceable undertaking relating to alleged breaches of the life support provisions under the National Energy Retail Rules
- Ford Australia in ACCC proceedings alleging unconscionable and misleading conduct in relation to the application of consumer guarantees
- Australian Energy Council, Clean Energy Council and Energy Consumers Australia in Australian Competition Tribunal proceedings securing ACCC authorisation for the New Energy Tech Consumer Code (which set standards of conduct for suppliers of new energy tech products), in relation to a challenge by a 'buy now pay later' finance provider
- a major financial institution in the ACCC’s residential mortgages inquiry
