About Kirsty Prinsloo

Kirsty specialises in restructuring, corporate insolvency and commercial litigation. She advises insolvency practitioners, creditors and other stakeholders in connection with distressed situations including restructurings and workouts, contingency planning and safe harbour plans, as well as formal and informal insolvency processes.

Kirsty also advises a range of clients in relation to commercial disputes across a range of industries including financial services, retail and agriculture.

She has received independent recognition including being ranked as a 'Recommended' restructuring and insolvency lawyer in Doyles 2025 and was named by Lawyerly in 2021 as a 'Litigation Rising Star'. Kirsty is also a member of the Turnaround Management Association.

Restructuring and insolvency
  • Good Fortune group: advising NAB as financier and McGrathNicol as receivers and managers of a specialist contractor management services provider
  • Project Co-ordination: advising NAB as financier and Deloitte as receivers and managers in relation to a property developer
  • Xpress group: acting for NAB as financier and McGrathNicol as receivers and managers in relation to an operator of a fleet of transport logistics assets and petrol wholesaler (In the matter of Xpress Fuel Australia Pty Ltd (Receivers and Managers Appointed) (Administrator Appointed) [2023] NSWSC 692 (22 June 2023) and In the matter of Press Australia Pty Ltd (receivers and managers appointed) (controllers appointed) in its own capacity and as trustee for Lassab Trust [2024] NSWSC 1219 (27 September 2024))
  • Forum group: acting for McGrathNicol as liquidators of the Forum Finance group, which perpetrated a $400m fraud upon its financiers, including various recovery actions
  • Navarre Minerals: advising Evolution Mining as securityholder and McGrathNicol as receivers and managers of a gold producer and a mineral exploration company
  • Quintis group: advising the bondholders and McGrathNicol as the receivers and managers of the Quintis group, a sandalwood plantation owner and manager, including in relation to the recapitalisation of the business through a deed of company arrangement and a creditors' scheme of arrangement
  • LJ Hooker group: advising Infrastructure Capital Group in relation to a debt restructure implemented through deeds of company arrangement
  • BP Energy Asia: acting for BP Energy Asia in relation to their exposure arising from the sale of carbon credits (Re Emerging Energy Solutions Group Pty Ltd (No 2) [2024] VSC 393)
  • Presbyterian Church of Queensland: acting for the court-appointed receivers of the Presbyterian Church of Queensland in relation to the sale of aged care facilities
  • Big Four Banks: advising and acting for the Big Four Banks in relation to various workouts and enforcement actions of various loans provided to distressed borrowers in a number of sectors, including professional services, pharmaceutical, resources and retail.
Commercial litigation
  • Greensill group: acting for Insurance Australia Limited in the defence of claims in excess of $7b resulting from the collapse of the Greensill group
  • BT Super class action: acting for BT Funds Management and Westpac Securities Administration Limited in defending a class action alleging breaching of trustee duties
  • Westpac Life Insurance class action: acting for Westpac in defending a class action involving the premiums associated with life insurance, including a successful appeal in the High Court of Australia in relation to common fund orders (Westpac Banking Corporation v Lenthall [2019] HCA 45)
  • Dick Smith group: acting for a former non-executive Chairman in successfully defending claims brought by the group's receivers for alleged breaches of directors' duties (DSHE Holdings (Receivers & Managers Appointed)(In Liquidation) v Nicholas Abboud (No 3) [2021] NSWSC 673)
  • ASIC proceeding against Westpac: acting for Westpac in defending proceedings brought by ASIC involving allegations of insider trading.
