Recent experience water-related experience includes:
Eastern Irrigation Scheme
Advising Melbourne Water on the development of an infrastructure scheme to reuse
treated water from Melbourne's Eastern Treatment Plant, including drafting and
negotiating a full suite of project documents and advising on alternative
project structures.
Natham Dam Surat Basin
Acting for the Queensland Government in the preparation and subsequent
granting of the concession agreement for the Natham Dam Project, the first major
clear water infrastructure BOOT project undertaken in Queensland.
Werribee Irrigation Recycled Water Scheme
Advising Melbourne Water on Victoria's largest commercial recycled water
project, including in relation to risk and liability issues and on the
negotiation and drafting of bulk recycled water agreements.
Burnett Water
Advising Burnett Water on all legal aspects of the Burnett Water
infrastructure projects, including the Burnett River Dam. We advised on all
aspects of the legal processes required to establish the project, including the
acquisition of land and the protection of native title rights.
Sydney water treatment plants
Advising on the BOO(T) financings of three of the four major water treatment
plants in the Sydney region – Macarthur (acting for the joint venture),
Illawarra and Woronora, including advising on the preparation and negotiation of
all project documentation.
Mini-hydro schemes
Acting for Melbourne Water in relation to the design, construction,
installation and operation of mini-hydro schemes throughout its water supply
network, including advising on risk allocation and property issues.
Southern Hydro
Advising Meridian Energy on its acquisition of hydro assets, including
Southern Hydro, and subsequent A$1.5 billion competitive trade sale of those
assets to AGL. This involved comprehensive due diligence, including reviewing
environmental flow arrangements, water entitlements and other licences.
Master planned communities, water reticulation services
Advising on water supply, drainage and sewerage infrastructure issues for
major private residential developments including the A$2 billion North Lakes
development (Queensland) and at Rouse Hill and Eastern Creek (New South Wales).
Water supply arrangements
Advising SunWater, which owns significant water infrastructure throughout
Queensland (including dams, pipelines, weirs and irrigation infrastructure), on
water supply issues arising from amendments to the regulatory framework
resulting from the commencement of the Water Act 2000.
BOOT schemes, regional Victoria
Advising the International Water Company on its proposal to build, own and
operate a series of water treatment plants, pumping stations and water pipelines
for two regional Victorian water authorities, including examining legal and
institutional arrangements affecting water supply in Victoria.
Wholesale bulk water supply and sewerage arrangements
Advising Melbourne Water on the water and sewerage agreements it has with
its three Victorian water retailers, covering drinking water volumes and
quality, sewerage and trade waste volumes and quality and the method of charging
for those services.
Beenleigh wastewater treatment plant
Acting for the Gold Coast City Council in relation to the review of tender
documents and the negotiation and finalisation of contracts for the design,
construction and maintenance of the Beenleigh wastewater treatment plant.
Water treatment plants, China
Acting for the China Water Company, as developer/sponsor of a water
treatment plant in Yantai City and in negotiating four joint venture agreements
for the construction and operation of water treatment plants in Shaoxing City,
Zhangzhou City, Shijiazhong City and Benxi City.
