ESG 2.0: Governance, regulatory enforcement action and disputes

As ESG matures, regulators, strategic litigants and other stakeholders are moving to test the corporate governance that sits behind ESG commitments and decision-making. In only the last few weeks, we have seen a new joint opinion on climate change and Australian directors' duties and an agreement by Fiducian to pay a pecuniary penalty of $7.3 million in ASIC's ESG governance case. 

In this webinar, we explore what we are calling ‘ESG 2.0’, the next phase of the ESG landscape – in which governance frameworks, board and executive accountability, and enterprise-wide risk management are coming sharply into focus. 

Our discussion will focus on trends and risks in six core pillars of governance: 

  1. The role of boards and directors duties.
  2. Executive accountability.
  3. Corporate policies and public statements.
  4. Risk and compliance procedures.
  5. Consultation with communities including First Nations.
  6. Speaking up and whistleblowing.
