About Joshua Anderson

Josh is a commercial litigator specialising in complex contractual disputes, class actions, regulatory investigations and insurance. Josh has acted for clients in the High Court of Australia, Federal Court of Australia, State Supreme Courts, and in negotiations and mediations.

Josh is known for being responsive and efficient. He grasps factually and technically complex matters quickly and provides pragmatic and commercial advice.

Commercial disputes

Josh brings a breadth of experience to commercial disputes, having worked as an associate to the Hon. Justice Moshinsky of the Federal Court and spent six months on secondment with the Australian Securities and Investments Commission.

Highlights of Josh's experience include:

  • acting for Nissan in defence of the Takata airbag class action in the Supreme Court of New South Wales (including various appeals);
  • acting for IAG in defence of the shareholder class action in the Supreme Court of Victoria concerning COVID-19 business interruption insurance disclosures;
  • advising various companies and directors in responding to ASIC investigations and enforcement activity;
  • representing a major ASX-listed companyon a significant transfer pricing dispute with the Australian Taxation Office;
  • assisting Crown Resorts and its subsidiaries on a range of matters including the Victorian Royal Commission into the Casino Operator and Licence and associated regulatory investigations; and
  • acting for Coles in relation to the ACCC's investigation and litigation of its dealings with certain suppliers.
Insurance claims

Josh routinely assists clients with a variety of high-value insurance disputes including D&O liability, professional indemnity, cyber, ISR (property damage and business interruption), public and products liability and reinsurance claims. Josh also has significant experience advising clients with their risk management and insurance programs, deepened by his time on secondment at IAG, Australia's largest general insurer.

Highlights of Josh's experience include:

  • acting for a multinational resources company on complex insurance issues arising out of a landslide that impaired mining operations, one of the largest in mining history;
  • representing Newcrest on significant claims for indemnity under the company's D&O insurance policy in connection with an ASIC investigation and separate shareholder class action;
  • acting for various Australian and international law firms and the Legal Practitioner’s Liability Committee on significant professional indemnity claims;
  • assisting an Australian miner with a property damage and business interruption claim following the failure of a leach tank at an ore processing plant;
  • acting for a multinational company on complex CGL insurance and reinsurance coverage issues in response to extensive product liability claims in the US; and
  • advising various clients on cyber insurance policy requirements, limits and exclusions.

Josh joined Allens in 2014, after graduating from Melbourne Law School with the Supreme Court Prize (as the year’s top graduate). He holds a Master of Laws with First Class Honours from the University of Melbourne. Josh publishes on areas of interest and was awarded the 2020 Baxt Prize for his paper on directors' duties.
