About Linda Govenlock PhD
Linda is a registered patent attorney in Australia and New Zealand and a registered Australian trade mark attorney. She specialises in intellectual property (IP) in the chemical and life sciences area, with a particular focus on securing, commercialising and defending patents for pharmaceutical and veterinary products, diagnosis and treatment of diseases, industrial and agricultural chemicals, industrial processes, biochemistry and food technology.Linda has extensive experience in both contentious and non-contentious patent matters, including:
- providing strategic IP advice to clients in relation to patentability, patent validity and freedom to operate.
- conducting patent oppositions before the Australian and New Zealand patent offices.
- providing specialist support in patent litigation involving pharmaceutical and chemical patents.
- drafting patent specifications for new inventions.
- prosecuting and securing patent protection for inventions throughout the world.
- securing extensions of term for pharmaceutical patents.
- carrying out due diligence on existing or pending patent rights.
- IP portfolio management.
- IP reviews to identify opportunities for protecting and commercializing IP.
A large focus of Linda's practice is in securing, defending and enforcing patents. Linda works closely with Allens' IP litigation team in proceedings before the Federal Court of Australia involving the validity and infringement of commercially valuable pharmaceutical patents owned by various multinational pharmaceutical clients. She has advised on and implemented the strategic defence of a portfolio of patent owned by another international pharmaceutical client that is being challenged before the Australian Patent Office, as well as representing that client in a challenge to the validity of a competitor's patent application. More recently, Linda has provided validity and infringement advice to an industrial client as part of a review of its IP portfolio to identify commercial opportunities to leverage its IP. For another client, Linda is handling several applications before the Australian Patent Office to extend the terms of granted patents covering commercially significant pharmaceutical products. Linda has also advised Australian clients in relation to securing patent protection for their inventions in Australia and overseas and provided advice on the commercialisation of those patent portfolios.
Linda has a BSc (Hons 1) majoring in chemistry and pharmacology from the University of Sydney and a PhD in organic chemistry, also from the University of Sydney. Linda was awarded a Royal Commission for the Exhibition of 1851 Research Fellowship and completed three years Postdoctoral Research at the University of Durham, UK, studying new MRI and PET agents. Upon returning to Australia Linda joined the patent profession in 2000 and gained a Masters of Industrial Property Law. During 2005 and 2006 Linda worked in the UK IP Department of a multinational pharmaceutical company, gaining invaluable experience in European patent practice and patent portfolio management.
Linda is a Fellow of the Institute of Patent and Trade Mark Attorneys of Australia and a member of the Intellectual Property Society of Australia and New Zealand.
Linda has been trained formally in Legal Project Management, most recently attending a full-day LPM workshop delivered by US legal project management expert Susan Raridon Lambreth. Linda's LPM expertise drives efficient legal and business outcomes for her clients.
