About Shirleen Kirk

Shirleen helps clients to manage and resolve disputes and regulatory issues arising in the construction, energy and redevelopment sectors, with a particular focus on the energy transition. She supports clients to overcome hurdles and achieve the best commercial outcomes, with extensive experience in court litigation, arbitration, expert determination and mediation.


Shirleen has been recognised in Doyle's Guide as a 'rising star' in construction law and she has practised commercial litigation in London and Sydney.

Shirleen's experience includes advising:
  • Various principals and contractors – concerning scope, extension of time, certification, defects and other claims under development contracts in energy, real estate and civil works projects, including in arbitration and NSW Supreme Court litigation;
  • Energy market participants – on regulatory investigation and enforcement processes, frameworks, administrative review, and registration and commissioning delays;
  • Real estate developers and landlords – concerning disputes arising during real estate development projects, including in arbitration and at trial in the UK courts and NSW Supreme Court;
  • Renewable energy developer – in a commercial dispute arising from the development agreement for a wind farm development portfolio;
  • NSW solar farm principal – in a successful security for payment adjudication, arbitration, mediation and various ancillary disputes concerning design, construction, registration and commissioning of a NSW solar farm;
  • Energy network principal – in various design and construction phase disputes arising on a major transmission network project;
  • Queensland wind farm principal – in disputes concerning construction defects, delay and scope;
  • Snowy Hydro – on the Snowy 2.0 project;
  • Transmission network operator – in disputes concerning access and acquisition of land to install wind turbines and network infrastructure;
  • The State – in an expert determination concerning decommissioning, demolition and rehabilitation of a NSW coal fired power station; and
  • Local government agency – in a commercial dispute against a major energy company in expedited court proceedings.
