Energy storage technology – including batteries and pumped hydro – will play a fundamental part in Australia's energy transition, supporting both grid-connected and remote generation assets.

In addition to their ability to help overcome network and off-grid challenges associated with the nature of generation from renewable energy sources, energy storage assets provide owners with a diverse range of revenue opportunities – including through the provision of system strength and ancillary services, and energy arbitrage and government underwriting initiatives. As energy consumers' demand for 'green electrons' continues to grow, access to storage assets will enable energy retailers to provide this product to their customers.

We are leaders in large-scale battery and storage project developments and financing in Australia. Our team has advised clients on first-to-market energy storage technologies, and some of the largest battery and pumped hydro projects in Australia. We have an in-depth understanding of current market conditions, and use our expertise to guide clients on all aspects of the storage project lifecycle. 

Our work includes:

  • tenure, planning approvals and environmental, cultural heritage and native title issues (which can be particularly complex for projects with larger footprints, such as pumped hydro projects);
  • project structuring and tax advice;
  • project and portfolio financing, including government funding initiatives and opportunities, inbound foreign capital, equity and debt;
  • project acquisitions and disposals, including projects in procurement and under development;
  • navigating technology risk as energy storage technology continues to develop, as well as regulatory approvals and reform;
  • connection strategy and (for pumped hydro projects) water source risk;
  • engineering, procurement and construction, including advising on supply chain issues (eg critical minerals availability), contracting strategies, software implementation, and interface and integration risk;
  • operation and maintenance, including issues related to performance warranties, degradation risk and implementing operating protocols; and
  • offtake and revenue strategy, which includes advising on revenue stack and energy arbitrage opportunities, novel and complex tolling and revenue structures (including virtual and physical arrangements), revenue underwriting schemes (including the Capacity Investment Scheme) and future markets.

Experience

Pelican Point BESS

Advised ENGIE on all aspects of its procurement of the Pelican Point Battery Energy Storage System (BESS), a major project strengthening South Australia's transition to renewable energy.

Elaine BESS

Advised Akaysha Energy on the $460 million construction financing of the 311MW / 1,244MWh Elaine BESS, to be developed in Victoria's South West REZ.

Joel Joel BESS and Little River BESS

Advised ACEnergy on its successful participation in the Capacity Investment Scheme (CIS) Dispatchable Capacity tender round 3, securing support for its two BESS projects – Joel Joel BESS and Little River BESS. This was the first National Electricity Market-wide dispatchable generation tender under the CIS. CIS agreements and other similar government support agreements will continue to play an important role in enhancing the bankability of renewables and storage projects.

Energy trading evolution

Advised ENGIE in Australia on their first 100% virtual storage agreement to be entirely de-linked from a physical battery asset, marking a significant milestone in the evolution of energy trading in Australia.

Snowy Hydro 2.0

Advising on all funding, construction, environmental planning, regulatory and real estate aspects of the expansion scheme.

Offtake structures

Advised on novel and complex offtake strategies for battery and pumped hydro projects, using a variety of structures, including revenue sharing agreements, physical and virtual tolling agreements, swap contracts, support agreements and revenue underwriting contracts.
